The EPA has again postponed the public hearing on its proposed rule revising the Greenhouse Gas New Source Performance Standards (GHG NSPS) for new, modified, and reconstructed coal-fired Electric Generating Units (EGUs) under section 111(b) of the Clean Air Act.
The hearing, which was first scheduled for January 8, 2019, was rescheduled for January 30, 2019, due to the government shutdown. Because the shutdown remains ongoing, EPA has now indefinitely postponed the hearing. EPA says it will provide updated information when the shutdown ends and will provide at least two weeks’ notice of the new hearing date and location. The comment period on the proposed rule will need to be extended because the Clean Air Act requires the record to be held open for 30 days following a public hearing. This means that the comment deadline will be extended until at least early to mid-March.
